Can You Be Jailed for Not Repaying a Loan?

Short answer

No. Loan default in India is a civil matter, not a criminal offence. You cannot be sent to jail simply for missing EMIs due to genuine financial difficulty.

If you miss repayments, your bank or NBFC (Non-Banking Financial Company) can send notices, report your account to credit bureaus like CIBIL, and file a civil recovery case in court. None of these routes lead to jail for a good-faith borrower.

When jail becomes possible

Imprisonment is only relevant when fraud is involved โ€” for example, taking a loan using forged documents or with deliberate intent to cheat the lender. This falls under the Indian Penal Code's cheating provisions, not simple default.

Can Recovery Agents Call You After 7 PM?

No. RBI's guidelines on fair practices are explicit on permitted contact hours:

Digital Loan Apps Can No Longer Access Your Contacts

  • Visiting your workplace in a manner that causes embarrassment or professional harm
  • Contacting family members, friends, or colleagues for anything other than locating you
  • Making repeated harassing calls within a single day
  • Impersonating police officers, lawyers, or court officials
  • Making false statements about legal proceedings that haven't actually been filed

If an agent claims you will be "arrested tomorrow" without any court order, that is a threat and a misrepresentation. Document it immediately.

What to Do If You're Being Harassed

  1. Build your evidence file Record calls where legally permitted, screenshot WhatsApp messages, and note exact call times and dates. This documentation is essential for any complaint.
  2. Write to the bank or NBFC directly Send a formal email to the lender's grievance officer โ€” their contact details must be on their website per RBI requirements. Mention the agent's name, time, and nature of the violation.
  3. Escalate to the RBI Ombudsman If unresolved within 30 days, file a complaint on the RBI Complaint Management System (CMS). It's free and can be done online.
  4. Approach the Consumer Forum or Police For serious harassment โ€” threats, public defamation, or data misuse โ€” you can file an FIR at your local police station or approach the National Consumer Helpline. A lawyer familiar with consumer rights can help you assess your options.

Ignoring the Loan Is Not a Solution
